Bowsmith Trade Warranty Policy and Disclaimer

BOWSMITH, INC.(BOWSMITH) warrants that its products will be free from original defects in materials and workmanship for a period of one year from date of original sale. Bowsmith will replace, free of charge, products found to be defective under normal use and service within the warranty period, upon return of such products at the customer ’s expense after return has been authorized in writing by Bowsmith. Bowsmith will not be responsible for incidental or consequential damages arising or resulting from the use of defective products or for products that have been altered or modified or that have been installed or used not in accordance with Bowsmith ’s recommendations or specifications. Bowsmith ’s liability under this warranty is limited solely to replacement or repair of defective parts or assemblies. No agent or representative has authority to waive, alter, or add to the printed provisions of this warranty or to make any representation or warranty not contained herein. This limited warranty (including the special warranty supplement for polyethylene irrigation tubing printed below) shall constitute the sole remedy of any purchaser or user of Bowsmith products, and is in lieu of any implied warranty of merchantability or of fitness for a particular purpose or other warranty of quality, whether express or implied, except the warranty of title. Bowsmith cannot and does not assume liability for defective products or damage caused by defective products, not manufactured or supplied by it, even though such be used in conjunction with products manufactured by Bowsmith.

Bowsmith reserves the right to redesign, alter, or modify its products without incurring any liability from anyone ’s inventory of such products that may become obsolete. Bowsmith further reserves the right to change its prices at any time without prior notice.

Special Warranty Supplement for Premium Plus Tubing

For Premium Plus tubing manufactured by Bowsmith, Inc., Bowsmith ’s Trade Warranty Policy and Disclaimer is modified as follows:

1. Warranty periods are extended as follows: For all Premium Plus Tubing: from one year to seven years.

2. This warranty supplement does not extend to tubing supplied but not manufactured by Bowsmith.

3. All such tubing will be free from environmental stress cracking caused by the effects of sunlight and/or operating pressures and temperatures occurring during normal use and service.

4. All of the other terms and conditions of the Bowsmith Trade Warranty Policy and Disclaimer not specifically and expressly modified by this warranty supplement remain in effect.
